The current discussion on property of natural resources frequently draws on the idea of an original common ownership of the earth. Starting from early modern theory, Eva Weiler analyses the role of this idea for the justification and critique of property titles and the legal order, and its persistent failure to adequately address humans’ relationship to nature.
